For other programmes, payment takes the form of residuals (set percentages of each individual artist’s original fee defined according to the use being licensed (eg video distribution, cinema exhibition, terrestrial, satellite or cable television transmission), and the territory in which the licence is being granted.

Individual performers may negotiate restrictions on the BBC’s right to license the programme in specified territories or for defined uses in their contracts. The terms of the BBC/Equity agreement do not override those of the individual contract.

The detail of the agreement covers such matters as the right to include part of the artist’s performance in the opening and closing sequences of series and serials, in flashbacks and in trailers, the right to use extracts in other programmes, the rights in signature tunes performed by variety acts or chorus singers,

the use of material recorded but not used in the programme, the use of still photographs, the rights in relays (live or deferred) of public concerts, the use of television commercials in BBC programmes, and the making of programmes by the BBC for other broadcasters (excluding ITV, C4 and C5).

The agreement stipulates minimum fees for the artist’s work and for all these uses of it. In practice, most artists other than Supporting Artists, Walk-ons, Chorus Singers and Group Dancers and Skaters are able, usually through their agents, to negotiate fees above these minima. It also defines the conditions under which the work is undertaken: working hours, overtime payments, travel arrangements and so on.
